Terms of Service

1. Description of Service

AbalonAds AI is a platform that uses 5 specialized artificial intelligence agents (Account Manager, Data Analyst, Copy & Art Director, Media Buyer, and Trafficker) to create, optimize, and publish advertising campaigns on Meta Ads. The Service includes generating ad copy, images, audience definition, bidding strategies, and direct publishing to Meta Ads.

2. Registration and Account

• You must be at least 16 years old to use the Service
• You must provide accurate information and keep it up to date
• You are responsible for maintaining the security of your account and password
• You may not share your account with third parties or transfer it
• You must notify us immediately if you suspect unauthorized access

3. Plans and Payments

• The Service offers different subscription plans with monthly credits for campaign creation
• Payments are processed securely through Stripe
• Subscriptions automatically renew at the end of each billing period
• You can cancel your subscription at any time. Cancellation will be effective at the end of the current billing period
• Unused credits do not roll over between billing periods, unless the plan indicates otherwise
• Refunds are evaluated on a case-by-case basis according to our refund policy

4. Acceptable Use

By using the Service, you agree not to:

• Create campaigns that promote illegal, fraudulent, misleading, or offensive content
• Violate Meta Ads advertising policies
• Attempt to access other users' accounts or internal platform systems
• Use the Service to send spam or unsolicited communications
• Reverse engineer, decompile, or disassemble the software
• Use bots, scrapers, or other automated means to access the Service without authorization

5. Intellectual Property

• The AbalonAds AI platform, including its design, code, algorithms, and brand, is the property of AbalonAds AI
• AI-generated content for your campaigns (copy, images, strategies) belongs to you once created
• You grant us a limited license to use your content for the purpose of providing and improving the Service
• We do not claim ownership of the content you upload to the platform

6. Artificial Intelligence — Limitations

• AI-generated content is a suggestion and should be reviewed before publishing
• We do not guarantee specific campaign performance results (ROAS, conversions, etc.)
• Metrics and statistics shown are estimates based on historical data and predictive models
• You are responsible for verifying that generated content complies with Meta Ads policies and applicable laws

7. Limitation of Liability

To the maximum extent permitted by law, AbalonAds AI shall not be liable for indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or use, whether in contract, tort, or other legal theory. Our total liability shall not exceed the amount paid by you in the last 12 months.

8. Termination

• You can cancel your account at any time
• We reserve the right to suspend or terminate your account if you violate these Terms
• Upon termination, you will lose access to your account and stored data (subject to our data retention obligations)
• Sections on intellectual property, limitation of liability, and governing law survive termination

9. Modifications

We reserve the right to modify these Terms at any time. We will notify you of significant changes at least 30 days in advance through the platform or by email. Continued use of the Service after the effective date of changes constitutes your acceptance of the modified Terms.

10. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any dispute arising from these Terms shall be resolved through binding arbitration, unless applicable law requires otherwise.
